Epilar
should be applied by a trained therapist. You are not required to
provide license # to purchase Epilar, however if you are not properly
trained, you will not receive the full benefit of the Epilar system.
Your hair needs to be completely removed by the root in order for the
Epilar system to work effectively.
GOODS
Seller
agrees to provide the goods (the “Goods") in accordance with the
applicable purchase with these Terms and Conditions ("Agreement").
This Agreement may not be added to, modified, superseded or
otherwise altered,
except by writing signed by an authorized shop Epilar representative.
RETURNS
Due to the nature of the product being sold, no returns will be
accepted. <

DELIVERY
Delivery of Goods shall be made using the US
postal service. US
shipments will be shipped 1st
class mail and International shipments shall be shipped express mail
international. Shop Epilar can alter the
shipping method at any time without
notifying
the buyer
WARRANTIES
Seller warrants that all Goods provided will be new and will
not be used or
refurbished. Seller warrants that all Goods delivered shall be free
from
defects in materials and workmanship and shall conform to all
applicable
specifications. Any claims shall be
directed to Epilar Corporation. Shop is
strictly
a distributor and has not stake in the
manufacturing of Epilar. Shop Epilar
cannot be help responsible for any damage that may arise from any
Epilar
product sold
BYERS RESPONSIBILITY
The buyer is responsible for any and all taxes imposed by
their country. This may in clued but not
limited to customs
tax, duty tax or any other such tax..
INDEMNITY
Seller shall indemnify, hold harmless, and at Shop Epilar’s
request, defend
Shop Epilar , its officers, directors, customers, agents and employees,
against
all claims, liabilities, damages, losses and expenses, including
attorneys'
fees and cost of suit arising out of or in any way connected with the
Goods
provided under this Agreement, including, without limitation, any claim
by a
third party against Shop Epilar alleging that the Goods, or any other
products
or processes provided under this Agreement, infringe a patent,
copyright,
trademark, trade secret or other proprietary right of a third party,
whether
such are provided alone or in combination with other products.
LIMITATION OF LIABILITY
IN NO EVENT SHALL SHOP EPILAR BE LIABLE TO SELLER OR SELLER'S
ASSISTANTS, OR
ANY THIRD PARTY FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL
DAMAGES
ARISING OUT OF, OR IN CONNECTION WITH, THIS AGREEMENT, WHETHER OR NOT
SHOP
EPILAR WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
GOVERNING LAW
This Agreement shall be construed in accordance with, and
disputes shall be
governed by, the laws of the State of Pennsylvania,
excluding its conflict of law rules. The state and federal courts in Pennsylvania
shall have
jurisdiction and venue over all controversies arising out of, or
relating to,
this Agreement.
ENTIRE AGREEMENT
This
Agreement is the complete, final and exclusive statement of the terms
of
the agreement between the parties and supersedes any and all other
prior and
contemporaneous negotiations and agreements, whether oral or written,
between
them relating to the subject matter hereof. The terms and conditions of
this
Agreement shall prevail notwithstanding any variance with the terms and
conditions of any acknowledgment or other document submitted by Seller.
